Terms and Conditions for Island Tours with the Boat Sellebrunn
§ 1 General, Scope These General Terms and Conditions govern the contractual relationship between the online shop/booking portal and the natural and legal persons who use the booking system (hereinafter referred to as the buyer).
The T&Cs apply to the use of the following website: sellebrunn-helgoland.de and the integrated booking system on this site.
§ 2 General Transportation Conditions
- The General Transport Conditions (GTC) are available on our website and with the captain on site, and are thus part of our transport contract. The GTC generally apply to both paid and free transport with the Boat Sellebrunn.
- By purchasing and receiving a valid booking confirmation, each passenger acknowledges the GTC/AGB as binding.
§ 3 Transport Contract and Transport Fees
- Passengers, as well as accompanying pets such as dogs, etc., will only be transported if a transport contract is concluded before departure.
- The current valid transport prices are published on the website of the Boat Sellebrunn or can be inquired about with the captain on site.
- The booking confirmations are only valid if they are undamaged and dated.
- The passenger is obliged to present the booking confirmation to the captain or a crew member of the Boat Sellebrunn before departure, without being asked.
- Booking confirmations may only be stamped by the captain or an authorized representative of the Boat Sellebrunn. Tickets that are invalidated by the passenger through their own fault before the inspection by an authorized representative, or that are lost, will not be replaced.
- The fare for tickets will not be refunded upon return, regardless of the circumstances. If transport is canceled due to operational fault caused by weather conditions, the full fare will be refunded. In this case, the original booking confirmation, or in justified cases, a copy, must be submitted when making a claim.
- Claims for or applications for a refund of the fare must be submitted immediately, and no later than two weeks after the expiration of the ticket's validity, to the captain on site.
- Passengers who pose a danger, such as those under the influence of excessive alcohol or exhibiting conspicuous behavior before or during the journey, may be excluded from transportation. In this case, there is no obligation to provide transport or refund the fare.
- Every passenger is required to follow the captain’s and crew's instructions to ensure necessary safety and order on the boat. Passengers are prohibited from contaminating or damaging the interior or exterior of the boat, misusing or damaging safety equipment, or removing any items from the vehicle.
- The owner of the Boat Sellebrunn assumes no responsibility, guarantees, or liability for passengers' belongings; each passenger is fully responsible for their own property.
§ 4 Conclusion of Contract for Bookings on Our Booking Portal (1) Our online offers are an invitation to the buyer to make bookings for events.
(2) By booking or reserving an event, the buyer enters into a binding purchase contract.
§ 5 Payment, Due Date, Late Payment (1) Payment for tickets is made through the integrated payment modules of external providers.
(2) The customer agrees to pay the purchase price immediately upon conclusion of the contract.
(3) Ticket bookings are considered a purchase of a product and can be canceled free of charge until 6:00 PM the day before the event. After that, a cancellation fee of 50% of the total price applies. From 3 hours before departure, a cancellation fee of 100% of the total price applies for any type of ticket, unless it can be proven that the use of the trip was not possible due to health reasons or force majeure. Vouchers purchased via email cannot be refunded in cash and are not transferable without consent to third parties.
§ 6 Delivery (1) Delivery occurs by sending the reservation confirmation to the email address provided by the buyer at the time of booking. The delivery period is immediately after payment, and the reservation confirmation is sent by email. If there is a delay in receiving the booking confirmation by email, the spam folder of the email program should first be checked. If no email confirmation has been received, the website owner must be contacted.
(2) No shipping costs are incurred for purchasing booking confirmations, as these items are delivered via email. If the buyer requests postal delivery, the buyer must cover the additional shipping costs.
§ 7 Prices (1) The price stated for the booking is the final price excluding VAT (according to §4 No. 5c UStG). The price does not include potential shipping costs; all other sales costs or incidental costs are included.
(2) With the update of the website or booking portal, all previous prices become invalid. Price changes are reserved at any time.
(3) The price at the time of the buyer's order is decisive for the invoicing.
§ 8 Warranty In the case of booking trips, claims for defects are generally excluded after the event.
§ 9 Limitation of Liability (1) The booking portal is only liable for damages other than those resulting from injury to life, body, or health, to the extent that these damages are caused by intentional or grossly negligent actions or by a culpable breach of an essential contractual obligation by the booking portal. Any further liability for damages is excluded.
(2) According to the current state of technology, data communication over the Internet cannot be guaranteed to be error-free or always available. We are therefore not liable for the continuous availability of our booking portal.
§ 10 Jurisdiction All disputes arising from this legal relationship are subject to the law of the Federal Republic of Germany.
The applicability of EU purchase law is excluded.
If the contracting parties are merchants, the court at the business location of the booking portal is responsible, unless an exclusive jurisdiction for the dispute is established.
The same jurisdiction applies if the buyer has no general jurisdiction in the domestic country.
§ 11 Right of Withdrawal You may revoke your contractual declaration regarding the purchase of a ticket from our booking system within 14 days without giving reasons in writing (e.g., letter, email), or - if you have been provided with the voucher before the deadline - by returning the voucher. The deadline begins after receiving this information in writing, but not before the ticket or voucher has been received by the recipient, and not before we have fulfilled our information obligations in accordance with Article 246 § 2 in conjunction with § 1 para. 1 and 2 EGBGB, as well as our duties under § 312e para. 1 sentence 1 BGB in conjunction with Art. 246 § 3 EGBGB. To observe the withdrawal deadline, it is sufficient to send the withdrawal or the voucher in time.
